Judge issues second ruling against Pacifica – this time over KPFK election

On Friday, February 18, Alameda County Superior Court Judge Frank Roesch issued a preliminary injunction ordering the Pacifica National Board to seat Rodrigo Argueta as a staff representative from KPFK, the Pacifica station in Los Angeles.

In a case that closely paralleled Pacifica’s unlawful meddling in the staff election at KPFA — overturned by the same judge two months ago — the incumbent members of Pacifica’s National Board tried to protect their majority by invalidating the election of Argueta, ordering KPFK to hold a new election, and in the meantime, illegally extending their own terms of office.

Pacifica is the license-holder for KPFA (Berkeley), KPFK (Los Angeles), KPFT (Houston), WBAI (New York City) and WPFW (Washington, DC), and each station’s elected local board in turn elects 4 representatives to the Pacifica National Board. Argueta’s seating will further weaken the control of the group that backed the termination of the Morning Show and the layoffs of Aimee Allison and Brian Edwards-Tiekert at KPFA, and the hiring of a management-style law firm with listener dollars.
